This website, www.pikkme.com (the "Site" or "Website"), is owned and operated by Pikkme, a sole proprietorship of Himanshu Pal, having its registered place of business at B-101, Arjun Park, Nangli Sakrawati, New Delhi – 110043, Delhi, India. GSTIN: 07CUQPP2942A1ZK. In these Terms, "Pikkme", "we", "us" and "our" refer to this business, and "you" or "your" refers to the user or customer of the Site.
1. Acceptance of Terms
By accessing or using the Pikkme website (the "Site"), you agree to comply with and be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the Site.
The Terms and Privacy Policy displayed on the Website, once accepted by you, become a legally binding contract between you and us. Your use of the Website and your purchase of any products displayed on the Website is a clear indication that you have completely agreed to the Terms and the Privacy Policy of the Website and to all the rules, policies and procedures relating to the services provided by Pikkme, including in relation to the use of the Website, as amended from time to time. 2. Eligibility, Account and Registration
In consideration of your use of our Website, you represent that you are of legal age to form a binding contract under the Indian Contract Act, 1872 and are not a person barred from receiving services under the laws as applicable in India. If you are under 18 years of age, you may use the Site only under the supervision of a parent or legal guardian.
You also agree to provide true, accurate, current and complete information about yourself as prompted by our Website’s registration or checkout forms. If you provide any information that is untrue, inaccurate, not current or incomplete (or becomes untrue, inaccurate, not current or incomplete), or we have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of our Website (or any portion thereof). You undertake to indemnify and keep indemnified Pikkme for any loss, claim, damage or costs (including legal and professional costs) relating to any abuse or violation, including those aforesaid.
3. Use of the Site
You may use the Site for lawful purposes only. You agree not to use the Site:
- In any way that violates any applicable law or regulation in force in India, or any applicable law of the jurisdiction from which you access the Site;
- To send, knowingly receive, upload, download, use or re-use any material that does not comply with these Terms;
- To transmit, or procure the sending of, any advertising or promotional material without our prior written consent;
- To impersonate any person, or to misrepresent your identity or your affiliation with any person;
- To attempt to gain unauthorised access to, interfere with, damage or disrupt any part of the Site, the server on which the Site is stored, or any server, computer or database connected to the Site.
4. Account Security
If you create an account on the Site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your device. You agree to accept responsibility for all activities that occur under your account or password. Pikkme will never ask you for your card CVV, UPI PIN, internet banking password or any OTP over a phone call, email, SMS or WhatsApp message. Please do not share these details with anyone claiming to represent Pikkme.
5. Product Descriptions
We attempt to be as accurate as possible with product descriptions. However, we do not warrant that product descriptions or other content on the Site are accurate, complete, reliable, current or error-free. Product colours may appear slightly different on your screen due to display settings and photography lighting. If a product delivered to you is not as described, your sole remedy is to return or seek a replacement for it in unused condition in accordance with our Return, Refund and Replacement Policy.
6. Pricing, Currency and Taxes
All prices displayed on the Site are in Indian Rupees (INR / ₹) and are inclusive of all applicable taxes, including Goods and Services Tax (GST), unless expressly stated otherwise on the product page or at checkout. Any shipping charges, if applicable, are shown separately at checkout before you confirm your order.
Where a struck-through or "compare at" price is shown next to a product, that figure is the Maximum Retail Price (MRP) printed on the product packaging, which is inclusive of all taxes. The price shown alongside it is Pikkme’s actual discounted selling price, and that is the amount you will be charged at checkout. All products are sold at or below the printed MRP.
All prices are subject to change without notice. Despite our best efforts, a small number of products may be mispriced. If the correct price of a product is higher than the stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation, and any amount already paid by you will be refunded in full.
7. Payment Terms and Card Security
All orders on the Site are 100% prepaid. Cash on Delivery (COD) is not available at present. Payment must be completed in full at the time of placing the order.
We accept the payment methods displayed at checkout, which may include UPI, debit cards, credit cards, net banking and supported digital wallets. By providing a payment instrument, you represent that you are authorised to use that payment instrument and that you authorise the amount of your purchase to be charged to it.
All payments on the Site are processed through third-party payment gateways that are authorised by the Reserve Bank of India (RBI) and are PCI-DSS compliant. Your payment information is transmitted directly to the payment gateway over an encrypted connection. Pikkme does not collect, process or store your complete card number, CVV, card expiry, UPI PIN, internet banking credentials or any OTP on its own servers. We only receive a confirmation of the transaction status, along with a transaction reference number, from the payment gateway.
We are not responsible for any failure, decline, delay or interruption caused by your bank, card issuer, wallet provider or the payment gateway. If an amount is debited from your account but the order is not confirmed on the Site, the amount is generally reversed automatically by your bank or the payment gateway within 5 to 7 working days. If it is not, please write to us at support@pikkme.com with the transaction reference and we will take the matter up with the payment gateway on your behalf.
8. Order Acceptance and Cancellation
Your order constitutes an offer to purchase. All orders are subject to acceptance by us, and a contract is formed only when we confirm dispatch of the order. We reserve the right to refuse or cancel any order, including where there is a pricing or description error, where the product is unavailable, where the delivery address is not serviceable, or where we suspect fraudulent or unauthorised activity. In such cases, the full amount paid by you will be refunded to the original payment method.
You may request cancellation of an order at any time before it is dispatched by writing to support@pikkme.com or by messaging us on WhatsApp at +91 88512 94403. There are no cancellation fees, and approved cancellations are refunded in full. Once an order has been dispatched, it cannot be cancelled.
9. Shipping and Delivery
We currently ship only within India. We do not accept international orders at this time. We will make every effort to deliver your order promptly through our logistics partners. Delivery timelines shown on the Site are estimates only, and we are not liable for delays caused by courier partners, natural events, public holidays, strikes, regional restrictions or incorrect or incomplete address details provided by you. 10. Returns, Replacements and Refunds
Please refer to our Return, Refund and Replacement Policy for complete information on returns, replacements, refunds and the applicable timelines. Approved refunds are processed to the original payment method within 5 to 7 working days of approval, and may take a further 3 to 5 working days to reflect in your account depending on your bank or card issuer.
11. Chargebacks and Fraudulent Transactions
If you believe a transaction on your payment instrument was unauthorised, please contact us first at support@pikkme.com so that we can investigate and resolve the matter quickly. Raising a chargeback with your bank without first contacting us may delay resolution.
We reserve the right to contest any chargeback that we believe to be invalid, and to submit order, payment and delivery records to the payment gateway, the acquiring bank or the card network as evidence. We also reserve the right to cancel orders, withhold shipments, suspend accounts and initiate appropriate legal action in cases of suspected fraud, misuse of payment instruments, repeated invalid chargebacks or abuse of our returns and refunds process.
12. Intellectual Property
All content on the Site, including but not limited to text, graphics, logos, images, product photographs and software, is the property of Pikkme or its content suppliers and is protected by Indian and international copyright and trademark laws. You may not copy, reproduce, republish, distribute or exploit any part of the Site for commercial purposes without our prior written permission.
13. Limitation of Liability
To the fullest extent permitted by law, Pikkme will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill or other intangible losses, resulting from (a) your use of the Site or inability to use the Site, or (b) any unauthorised access to or use of our servers and/or any personal information stored therein. In any event, our total aggregate liability to you in connection with any order shall not exceed the amount actually paid by you for that order.
14. Indemnification
You agree to indemnify, defend and hold harmless Pikkme, its proprietor, employees, agents, licensors and suppliers from and against all claims, losses, liabilities, expenses, damages and costs, including reasonable legal fees, arising out of or relating to your use of the Site or any violation of these Terms.
15. Changes to Terms
We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting on the Site. Your continued use of the Site following the posting of changes constitutes your acceptance of such changes. The "Last updated" date at the top of this page indicates when these Terms were last revised.
16. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any dispute arising out of or in connection with these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the competent courts at New Delhi, Delhi, India.
